What Do You Own in a Sectional Title Scheme?
When you buy into a Sectional Title Scheme, your ownership is carefully defined in law – it’s not always as simple as “my unit, my walls.”
Here’s how it works:
Your Section:
– Ownership is defined by the median line: the midpoint through the floor, walls, and ceilings of your unit.
– The median line also runs through windows, doors, and any structures dividing your section from another unit or from common property.
In practice, this means you own the “inside half” of these boundaries, while the Body Corporate owns the outside half.
Common Property – Driveways, lifts, roofs, gardens, and shared facilities belong to all owners jointly. Every owner holds an undivided share in the common property.
Exclusive Use Areas (EUAs) – Spaces such as parking bays, storerooms, or gardens may be allocated to you for exclusive use. These remain owned by the Body Corporate but are reserved for your benefit.
Geysers and Hot Water Systems – Owners own their geysers or heat pumps, even when these are situated on common property, such as in a roof space, on a roof for solar geysers, in a duct, or mounted on a perimeter wall.
Insurance – The Body Corporate insures the buildings (all sections and the common property). As an owner, you must separately arrange your own household contents insurance.
