Understanding Community Living Insurance

Living in a community scheme, whether it’s a Sectional Title complex or a Homeowners Association (HOA) estate, means sharing not just common spaces but also collective responsibilities. One of the most important of these is ensuring the entire property, and its members, are properly insured. This is where Community Living Insurance comes in.

What is Community Living Insurance?

Community Living Insurance refers to the combination of policies that protect:

  • The physical property (buildings and common areas)
  • The financial stability of the scheme
  • The personal liability of Scheme Executives (Trustees or Directors)
  • The safety and security of residents, visitors, and contractors

It is not a single product, but rather a framework of cover types tailored to the unique risks faced by community schemes.

 Why It’s Important

Community schemes face risks that individual homeowners don’t, including:

  • Shared structures and systems (roofs, lifts, electrical infrastructure)
  • Multiple occupants with different usage patterns
  • Collective governance and decision-making
  • Liability for contractors, visitors, and staff

Without adequate insurance, the scheme, and ultimately its members, may face severe financial consequences.

The Legal Framework

For Sectional Title schemes, the Sectional Titles Schemes Management Act (STSMA) requires:

  • Comprehensive buildings insurance for all units and common property
    • STSMA Section 3(h)
  • Public liability cover
    • STSMA Regulation 23(6)
  • Fidelity cover against theft of scheme funds
    • CSOS Regulation 15
  • Trustee indemnity cover
    • STSMA Regulation 8(4)

For HOAs, requirements are set by the constitution or Memorandum of Incorporation (MOI), but similar best practices apply.
